In this video, Rumbi Bvunzawabaya, Principal Solicitor, RBM Solicitors explains how to prove that one is eligible for a fee waiver while applying for Discretionary Leave to Remain in the UK.
She focuses on people who were granted Discretionary Leave to Remain after a failed asylum application. Previously such applications were dealt with free of charge.
Ms Bvunzawabaya says she has met a lot of people who have been unable to make applications due lack of money.
The current requirement is that even if you have been granted Discretionary Leave to Remain after a failed asylum, you still need to pay the application fees for extension or for indefinite leave to remain.
Ms Bvunzawabaya reveals out that there are exceptions and there is a fee remission form one can fill in to prove that they are unable to pay the fees.
She however, points out that this is only in exceptional circumstances and usually applies to people who are destitute and those who are on benefits. If you are working or own properties, then it becomes difficult to prove that you qualify for the fee remission.
Ms Bvunzawabaya then proceeds to outline the current immigration fees.
